C78 Update – Second series of case documentation expected in September

The plaintiffs’ lawyers expect to receive the materials in the pension surplus appeal from the federal government’s lawyers in September. The plaintiffs’ lawyers served their materials on the Attorney General of Canada and filed them with the Court of Appeal for Ontario in June. These included a 60-page factum, the 6-volume appeal book and compendium, and the 54-volume Exhibit Book.

A date is to be set for the appeal very shortly and it is anticipated that the appeal will be heard in early 2010.

    This is typical Government Protocal, put you asleep with extremely slow processes. I do believe in just does as we have numbers of membership that could effect an election and we should make it known.

    Just received my Notice to Canadian Forces Pensioners, November 2009, Canada/Quebec Pension Plan section.

    Blah, blah, blah ………….”In essence, the resulting reduction in contributions to the Canadian Forces Superannuation Account while a member was serving necessitated a corresponding adjustment to the benefits, such as annuities, that this fund could support.”

    Obviously the fund could support an INCREASE in benefits (annuities) had the $15B+ surplus been used for the benefit of members.
